Zombie Apocalypse Averted? Bath Salts Ban Passes U.S. Senate


In the wake of reports that bath salts may have played a role in Saturday's Miami zombie apocalypse attack, the U.S. Senate passed a bill to ban the substances.

Federal legislation criminalizing synthetic marijuana and some bath salts passed the Senate today and is now on its way to the House of Representatives.

The law was not passed as a result of the zombie apocalypse, but as part of the FDA Safety and Innovation Act, championed by Sen. Charles Schumer.

"Let this be a warning to those who make a profit manufacturing and selling killer chemical components to our teens and children," Schumer (D-NY) said.

"This bill closes loopholes that have allowed manufacturers to circumvent local and state bans," he said of the effort to ban "these deadly synthetic drugs."

Last Saturday, Rudy Eugene, 31, was shot dead by local police on the off-ramp of the MacArthur Causeway in Miami. He was eating another man's face.

As a police officer told Eugene to get off Ronald Poppo, he "just stood ... with pieces of flesh in his mouth and he growled," eyewitness Larry Vega said.

An ER doctor at the local Jackson Memorial Hospital told the Herald that Eugene's attack may have been brought on by psychosis caused by bath salts.

The extreme violence, super-human strength and an urge to shed clothes all correspond with reports of bath salt usage around the United States.

Pricing your apartment to sell has always been a crucial part of the process. But, now more than ever, I am seeing that marketing your home to sell at the right price could actually bring you more money. But what's even more important to know is that listing your home at an inflated pie-in-the-sky number can actually cost money and time. How? You ask... What do I mean by that?

Let me give you an example: We recently reduced the price on four of our listings and we had multiple offers on three and much more activity then before on the one that does not yet have offers. Two of these apartments had had little interest despite the lack of inventory out there and the others were flooded with inquiries, but not a single offer in 3 months' time.

Buyers have so much information through the internet these days. Sites like Elliman.com and Street Easy provide so much free info, that buyers are often much savvier than some brokers. This means they are very value driven. They'll quickly pass by an apartment that they do not feel is a good value, however negotiable the price may be. Especially with the real estate crisis still looming in the rearview mirror, no one wants to overpay. So the best strategy is to price your apartment based on its market value... In the first place!

The danger of overpricing your home is not only that you won't have the level of activity required to get the best price, but, adjusting your price later on weakens your negotiating power and position. However sound this advice may be, not every seller wants to listen. I guess we all hear things when we are ready to hear them. So sometimes we need to go on the journey with our sellers and go at their speed.

How do you know you are pricing your home right? First, you want to use an experienced broker who has a track record and who has your best interest at heart. Next you want to look at the sales activity in your building: What has sold recently, what's on the market and not selling? How does your apartment compare in condition? Is it a similar square footage, bed and bath size? Are you on a higher or lower floor? What has been renovated and what has not? Ideally you'll want to compare to a similar type apartment in your building. Then you want to go outside the building and look at similar buildings in the immediate area. These should be relatively close to each other, say a 10-15 block radius. If you can't find comps (comparables) then you can go a little further outside the immediate area, coops should be compared to coops and condos should be compared to condos. Once you get a feel for closed transactions in the past 3 months maybe as far as 6 months you should have a complete understanding of what your home will sell for.

Incidentally, the two apartments which did receive offers were both involved in bidding wars, which resulted in accepted offers over the asking price and very close to the original listing price. The moral of the story is: In a healthy market with an inventory shortage, a well price apartment in fair condition should fly off the shelf. If yours is sitting, you may want to re-think your price. Taking a good hard look at your home from a market standpoint may be a rough thing to do, but it will get you the most money in the fastest time, every time. (AP) ? It seemed like a good idea at the time.

But a health insurance tax credit for small businesses, part of President Barack Obama's health care law that gets strong support in public opinion polls, has turned out to be a disappointment.

Time-consuming to apply for and lacking enough financial reward to make it attractive, the credit was claimed by only 170,300 businesses out of a pool of as many as 4 potentially eligible million companies in 2010.

That's put the Obama administration in the awkward position of asking Congress to help fix the problems by allowing more businesses to qualify and making it simpler to apply.

But Republicans who run the House say they want to repeal what they call "Obamacare," not change it.

"They completely missed the target on this thing," Rep. Sam Graves, R-Mo., said of the tax credit. "I don't think expanding it is going to make any difference whatsoever." Graves chairs the House Small Business Committee.

It doesn't help the administration's plea that the biggest small-business lobbying group is a lead plaintiff asking the Supreme Court to overturn the Affordable Care Act. The National Federation of Independent Business isn't likely to spend much time tinkering with the tax credit or promoting it to members.

Small businesses represent the crumbling edge of the nation's system of employer-based health care. Only about 30 percent of companies with fewer than 10 workers offer health coverage, and they often pay more for insurance than large businesses. The credit, which once had support in principle from lawmakers of both parties, was supposed to help businesses already providing coverage afford the premiums. And maybe it would even entice some to start.

"We agree it is not a panacea for all costs," said John Arensmeyer, founder of Small Business Majority, an advocacy group that supports the health care law and disagrees with the much larger independent business federation. The problem is all the negative publicity around the health care law has discouraged business owners from applying for the credit, he says.

"There has been more heat than light shone on this," Arensmeyer said. "There is no reason why small businesses shouldn't be taking advantage of this credit." About 770,000 workers were covered by the businesses claiming the credit in 2010.

However, a recent report by Congress' nonpartisan Government Accountability Office identified several issues with the credit itself.

To begin with, the GAO said, the tax credit is structured so its biggest benefits go to very small companies paying low wages. About 4 out of 5 such businesses don't offer coverage, and the tax credit is not sufficient to encourage them to start doing so.

"Small employers do not likely view the credit as a big enough incentive to begin offering health insurance," the report said.

The average credit claimed in 2010 was about $2,700, although some companies qualified for much more.

Many small firms did not qualify because they paid fairly decent wages. The GAO report quoted an unidentified tax preparer who explained that "people get excited that they're eligible and then they do the calculations and it's like the bottom just falls out of it and it's not really there." It's almost a bait and switch.

Complexity has been another obstacle. IRS Form 8941, which employers must complete to claim the credit, has 25 lines and seven worksheets, the GAO said. Some tax preparers told the agency it took clients from two to eight hours to pull together supporting information and tax professionals another three to five hours to calculate the credit.

Trying to help, the IRS identified "three simple steps" employers needed to follow, but the GAO found "the three steps become 15 calculations, 11 of which are based on seven worksheets, some of which request multiple columns of information."

Arensmeyer said claiming the credit will be simpler once it becomes standard in tax-preparation software.

As it stands now, the credit is only temporary, expiring in 2016. That's another reason Congress appears unlikely to adopt the administration's proposed fixes, which would cost an estimated $14 billion that has to be offset with cuts elsewhere.

If the health care law withstands Supreme Court scrutiny, more employers could start claiming the credit. Otherwise, it may just go down as a missed opportunity, for policymakers and small-business owners alike.

Apple must open up its 'crystal prison': report

As the devices we use become more powerful, companies like Apple and Microsoft are exerting more control over how we use them. There is an increasing backlash against restrictions placed on how we can use our PCs and mobile phones, and the cause is being taken up by pundits of ever higher visibility. Recently?Steve Wozniak, one of Apple's founding members, called for the company to open up its software ecosystem, and the?Electronic Frontier Foundation, a free speech and?consumer and?advocacy organization, has echoed that sentiment with an article that calls Apple's devices and operating systems a "crystal prison."

For many users, the walls of this prison never seem to close in. There are thousands upon thousands of apps and games, useful features, and frequent updates from Apple. But for a growing minority (something which has a habit of eventually becoming a majority), the restrictions are worrying.

The EFF describes many of these deliberate limitations in detail, but here are some of the headline complaints ? not limited to Apple:

  • Apple's iOS disallows the installation of applications from anywhere but the official store, and the upcoming version of OS X discourages it strongly.
  • Every app in must be individually approved by Apple, sometimes with seemingly arbitrary conditions.
  • Users are unable to personalize the look and feel of their iPhone or iPad, and cannot improve or modify security settings like firewalls, VPNs or multiple users.
  • People who have installed custom software on their iPhones are no longer covered under warranty for hardware defects and things like cracked screens.
  • Microsoft is restricting some manufacturers from allowing the installation of any operating system but Windows 8 on certain hardware.
  • Carriers like AT&T insist on locking down phones with custom software (including invasive items like Carrier IQ) and "bloatware" apps that can't be removed.

These practices are good for the companies' bottom line, but they also erode trust and prevent some users from doing what they want to do with the devices they own.?

The EFF suggests that Apple, being the pioneer in this area of walled gardens and crystal prisons, should be the one to lead people out. Android has shown that a platform can be open to tinkering while still being fairly secure and liked by casual users, and?Apple has the clout and industry cred to help set a new standard.

Today, things like alternate OSes and third-party apps are only a matter of concern to power users and hackers. But as more people come to rely on these devices for a growing?variety of purposes, from music and movies to video calls and professional functions, these restrictions will become more and more visible.

Islamist, ex-military man contest Egypt presidency

CAIRO (Reuters) - Egypt's electoral committee declared on Monday that a run-off for the presidency would pit a Muslim Brother against a former ally of deposed leader Hosni Mubarak, but one losing candidate rejected the outcome of a "dishonest" vote.

The committee confirmed that the Brotherhood's Mohamed Mursi and ex-air force chief Ahmed Shafiq had proceeded to the second round of Egypt's first genuinely contested presidential vote.

Mursi topped the poll with 24.3 percent of the votes, followed by Shafiq with 23.3 percent. Turnout was 46 percent.

A Mursi-Shafiq run-off poses an agonizing dilemma for many of Egypt's 50 million voters who are equally wary of Islamist rule or a return to a military-backed authoritarian system.

About half of first-round votes went to candidates somewhere in the middle ground - from leftist firebrand Hamdeen Sabahy, third-placed with 20.4 percent, to moderate Islamist Abdel Moneim Abol Fotouh, with 17.2 percent, and former Arab League secretary-general Amr Moussa, with 10.9 percent.

All three filed complaints about the voting, all of which were rejected by the six judges forming the electoral committee.

The disputes add rancor to an already messy and often bloody transition to democracy since generals took over from Mubarak when a popular uprising forced him out on February 11, 2011.

"I reject these results and do not recognize them," said Abol Fotouh, a former Brotherhood member, alleging that votes had been bought and representatives of candidates had been denied access to polling stations during the count.

"The national conscience does not allow for labeling these elections honest," he said.

Of the 12 candidates, only Abol Fotouh has so far rejected the result outright.

"There are question marks on the result of the election," Moussa told a separate news conference earlier. "There were violations, but this should not change our minds on democracy and the necessity of choosing our president."

"ROLE MODEL"

The Muslim Brotherhood sought to muster a coalition to help Mursi against Shafiq, who calls Mubarak his "role model".

Neither man came close to winning the more than 50 percent of the vote needed to clinch the presidency in the first round.

The close contest has set both contenders scrambling for support, particularly the Muslim Brotherhood, which is trying to draw losing candidates and other political forces into a broad front to prevent a "counter-revolutionary" Shafiq victory.

Shafiq is also seeking wider backing, even posing as a protector of the revolt that toppled Mubarak.

Shafiq's supporters see him as the man to impose security and crack down on protests viewed as damaging to the economy. Mursi appeals to Egyptians keen for Islamists to run a deeply religious country within a democratic framework.

"I would bet that at some stage in the next two weeks there will be an upsurge in violence," said a Western diplomat, predicting than such a flare-up would likely boost the chances of Shafiq, campaigning on a law and order platform.

The military council has promised to lift a hated state of emergency in force throughout Mubarak's 30-year rule on May 31. It has also pledged to hand over to the new president by July 1.

A Brotherhood source, who asked not to be named, said the Islamist group's Freedom and Justice Party had prepared a menu of options to tempt rival groups and politicians to its side.

These include creating a five-member advisory council to advise the president; assigning the posts of prime minister or vice-president to Abol Fotouh and Sabahy; distributing cabinet posts to other parties and offering compromises on planned laws and on an assembly tasked with drafting a new constitution.

BROTHERHOOD CONTACTS

So far Abol Fotouh and Sabahy have appeared wary of such overtures, staying away from meetings called by the Brotherhood to discuss strategy for the second round of an election supposed to crown Egypt's turbulent army-led transition to democracy.

Moussa, a former foreign minister once seen as favorite to win the presidency, but who appears to have managed only fifth place, said he would stay in politics but was seeking no post.

"We cannot accept a re-creation of the (Mubarak) regime," he declared, but said he had not yet spoken with the Brotherhood on any anti-Shafiq coalition. "I am not going to consult them, but if they want to consult me, I will consider it."

Uncertainty over the election has hit Egyptian share prices. The main index dropped another 1.3 percent on Monday after suffering a 3.5 percent drop on Sunday, its worst in nine weeks.

"Investors are afraid because now we have two extreme candidates facing one another. No one will invest heavily in Egypt ... until it becomes clear who is president," said Amr Chamel, a trader at Pharos Securities.

"If Shafiq wins, foreign investors will feel at ease but there may be street protests against him. A Mursi presidency would scare off foreign investment."

International ratings agency Fitch said the Mursi-Shafiq contest could "exacerbate social unrest and prolong political stalemate", but said in the longer term both favored policies that could stabilize Egypt's sovereign credit profile.

Striking Air India pilots meet civil aviation minister ? New York Daily News

New Delhi/Mumbai, May 25 ? In a bid to end the 18-day-old strike at national carrier Air India, some of the agitating pilots met Civil Aviation Minister Ajit Singh here Friday.

?A few pilots in their individual capacity came in today to meet the minister. They wanted to rejoin duty and said they were ready to cooperate and discuss all outstanding issues,? a senior official of the ministry told IANS.

?They requested the minister to give them a fair chance to explain their stand,? the official said.

Ajit Singh reportedly advised the pilots to join back duty immediately after going through the mandatory guidelines and said none of them would be victimised.

?The minister has advised them to join back. He gave them a firm assurance that they would not be victimised in any way and that he is willing to discuss all their issues after they join back,? said the official.

The development comes as the strike by Indian Pilots Guild?s (IPG) members continued for the 18th day. The strike by over 400 pilots has crippled the airlines? international operations. The airline has lost some Rs.280 crore in revenue during this period.

Meanwhile, IPG said it had also offered to meet Ajit Singh and that it would immediately end the strike after reinstatement of 101 sacked pilots.

?We have sent a letter yesterday (Thursday) to the minister seeking a meeting with him, so that we can explain our situation to him personally. The letter was delivered to his aide. But till now, we have not received any invite,? Rohit Kapahi, committee member of Indian Pilots Guild (IPG), told IANS.

?We want a chance to put across our views to him in a fair and transparent manner, so that we can find a way to end the impasse. But till now, we have not received any reply,? he said.

The letter, which was sent to Singh on behalf of IPG general secretary E.A. Kapadia, said: ?An earnest dialogue will help resolve all issues in the interest of the country, the airline and its employees.?

Bisphenol A, or BPA for short, has been in the spotlight for decades, with both the chemical industry and occasionally the federal government touting its safety, while independent, non-industry funded scientific studies show us how dangerous the chemical truly is. The latest news regarding BPA is no different, with new independent studies showing that the common chemical has the potential to increase the risk of breast cancer when exposure occurs in the womb.

BPA is a common chemical used primarily in the production of plastics, such as baby bottles, canned goods (lining the inside of cans), soda bottles, and other common plastic goods that typically hold food or beverages (although it is found in countless other polycarbonate plastic products, including medical devices). It helps preserve the life of perishable goods, but comes at a dangerous cost to human health.

The chemical easily leaches out of plastic, and is either consumed by humans, or it can be absorbed through the skin. Estimates show that in the U.S., humans consume about 50 micrograms per kilogram of body weight everyday. The Centers for Disease Control (CDC) estimates that, at any given time, 93% of Americans have measurable amounts of BPA in their systems.

The latest study, released earlier this month, shows that in utero exposure to BPA in rhesus monkeys led to abnormalities in mammary gland?development.

This new study involved fetal BPA exposure, revealing chemical alterations in rhesus monkey mammary gland development, said the San Francisco Gate (SF Gate). For the study, researchers fed pregnant rhesus macaques monkeys a piece of fruit that contained BPA every day during their third trimester of pregnancy.

The monkeys? BPA blood levels reached the average level that BPA has been observed in human blood in the U.S., according to Patricia Hunt, a geneticist at Washington State University and a study author, said the SF Gate. The changes observed reinforce concerns that BPA could contribute to breast cancer, according to the team.

The researchers studied the mammary glands of the female offspring of BPA-exposed monkeys and discovered changes in those glands that lead to dense tissue, said the SF Gate. Dense breast tissue is a risk factor for human breast caner, Hunt explained. Prior and new studies conducted by Ana Soto and Carlos Sonnenschein, revealed that exposing rodents to small amounts of BPA could alter mammary gland development and lead to precancerous and cancerous lesions later in life.

Ana Soto, a co-author of the new study who has worked on previous BPA studies, said that this new information strongly suggests that ?BPA is a breast carcinogen in humans? and that exposure must be curtailed.

The breast cancer link is just the latest in the chain of health hazards associated with BPA. The Journal of the American Medical Association (JAMA) reported in 2008 that exposure to BPA was linked to an increase in cardiovascular diseases, type 2 diabetes, and liver enzyme abnormalities. And these effects were seen at relatively low-dose amounts of BPA, well below the amount actually consumed by Americans on a daily basis.

Many companies, including Playtex, Gerber, and several baby bottle manufacturers have voluntarily stopped using BPA in their products, as there are currently no national bans on the chemical. To understand why no bans exist, you have to follow the money.

Companies that manufacturer BPA ? including Dow Chemical and Bayer ? are bringing in a combined $6 billion a year selling the product. And that money has been put to good use convincing the American public that there is nothing to worry about.

In fact, they?ve done such a good job with their PR campaigns that they managed to convince the EPA to base their decision on whether or not the chemical is toxic on the industry?s own studies. Every single industry-funded study has shown that BPA is ?completely harmless,? compared to only 10% of independent studies that found no cause for concern.

One of the main defenders of BPA has been the American Chemistry Council (ACC), the leading front group for the chemical industry. To give you a hint at how their operation works, their former president is Jack Gerard, the current president of the American Petroleum Institute. The organization has spent millions of dollars in the last few years to defeat measures by the EPA to regulate the chemical more stringently, all of which were, predictably, dead on arrival.

In 2010, ACC spent almost $10 million in California alone to defeat measures aimed at curtailing BPA usage.

But the failure of the government doesn?t mean all hope is lost.

Consumers have some power to prevent BPA exposure. Choosing BPA-free products can help prevent exposure, as can purchasing fresh vegetables instead of canned items.

This article provides a few more tips on how to take preventative measures. As long as the industry is funneling money into Washington, the only regulation will come from consumers themselves, who can vote on this issue with their own wallets.?

Speaking of wallets, BPA is also used to coat the receipt paper that ends up contacting human skin at cash registers around the world. And a new study shows that the replacement for BPA, known as Bisphenol S, may also pose significant health risks.?

So while the consumer can take some steps to limit exposure, it truly falls to the government to investigate and protect consumers from these harmful chemicals. That will require getting rid of the influence of industry cash flowing into politicians' coffers, the most powerful contaminant of all in our democracy these?days.?

Water Gloves for Dads Who Surf

Water gloves or webbed gloves are used by dads who surf (or any surfer) to help them get to where they want to be in the water, but at a much faster pace. This is important when surfing as it can make the difference in catching a wave or not. In surfing, timing is critical.

This photo of my husband, Eric, was taken in 2008 by Leading Edge Photos. Look closely at his hands and you'll see he is wearing a pair of webbed water gloves in this picture. (The photographer just happened to be taking pictures at Eric's favorite surf spot and snapped a few pictures. It was a case of being in the right place at the right time.)
